Procedure

Foreign families may apply only for adoption of children with special needs


From 1st of April 2012 foreign nationals who are the permanent residents of a foreign state may apply to State Child Rights Protection and Adoption Service under the Ministry of Social Security and Labour only with an application for adoption of children with special needs. Besides, only spouses may apply for mentioned adoption.
Citizens of the Republic of Lithuania (spouses) and spouses whereof one is a citizen of the Republic of Lithuania who are the permanent residents of a foreign state may apply for adoption in usual order as it was before.
New rules regarding intercountry adoption came into force in accordance with the order of the Minister of Social Security and Labour No. A1-8 of January 10, 2012 Re: Amendments to the order of the Minister of Social Security and Labour of the Republic of Lithuania No. A1-162 “ Re: approval of the description of procedure for authorizing the institutions of foreign states to act in pursuance of international adoption in the Republic of Lithuania” of 3 June 2005.

Central Institutions

A Contracting State of Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption designates a Central Authority to discharge the duties which are imposed by the Convention upon such authorities.

Central Authorities shall co-operate with each other and promote co-operation amongst the competent authorities in their States to protect children and to achieve the other objects of the Convention.

Authorized Organizations

As of August 1st, 2006 no further authorization for inter-country adoption in Lithuania shall be granted to foreign institutions. In accordance with the Order of the Minister of Social Security and Labour No A1-195 of July 17, 2006, on the amendment to the Order of the Minister of Social Security and Labour of the Republic of Lithuania No A1-162 of June 3, 2005, on the approval of the specification of the procedure for granting authorization to foreign institutions in respect of inter-country adoption in the Republic of Lithuania, as of August 1st, new applications from foreign institutions seeking to get authorization in respect of inter-country adoption will not be accepted.
On 10 January, 2012 the Minister of Social Security and Labour of the Republic of Lithuania has approved the Order regarding Amendments to the order of the Minister of Social Security and Labour of the Republic of Lithuania No. A1-162 “Re: approval of the description of procedure for authorizing the institutions of foreign states to act in pursuance of international adoption in the Republic of Lithuania” of 3 June 2005. It establishes the procedure for granting authorization to foreign institutions in respect of inter-country adoption in the Republic of Lithuania, the procedure for termination and renewal of such authorization and suspension and revocation of it, also, the procedure for issuing and registering a certificate confirming one's authorization for inter-country adoption in the Republic of Lithuania, and functions, rights and duties of the authorized foreign institutions.

The Authorized foreign institution shall provide the Adoption Service with a feedback on the adopted children (during the first 2 years after adoption – every 6 months, during the following 2 years – once a year, after 4 years after adoption – upon request from the Adoption Service), that consists of reports of the prescribed form about the adopted child's integration into the family, living conditions, development and state of health and visual material.

166 families or persons willing to adopt were included into the database of the Service.  

Foreign national spouses, citizens of the Republic of Lithuania (spouses) and spouses whereof one is a citizen of the Republic of Lithuania permanently residing abroad

18 families willing to adopt a child were included into the database of the Service. Among them: 16 foreign national spouses permanently residing abroad, 2 spouses whereof one is a citizen of the Republic of Lithuania permanently residing abroad.

According to the data of December the 31st, 2017,  36 foreign national spouses, citizens of the Republic of Lithuania (spouses) and spouses whereof one is a citizen of the Republic of Lithuania permanently residing abroad adopted 47 children deprived of parental care (14 girls and 33 boys).
